Using this website
By using this website you agree to these terms. The content here, including the writing, design, the fingerprint mark and the ADS name, belongs to Authentic Digital Solutions. You are welcome to read it, quote it with attribution and link to it. You may not republish it as your own or use it to train a commercial model without our permission.
The articles on this site are general information, not advice for your specific situation. Acting on them is your decision.
Enquiries and the free audit
The Brand Fingerprint Audit is genuinely free and carries no obligation. Submitting the form does not create a contract between us, and we may decline to produce an audit if a request is out of scope, from a direct competitor, or clearly not made in good faith. We aim to deliver every audit within 3 business days.
Engagements
Paid work begins when we both agree a written scope and quote. That document, together with these terms, forms our agreement. If the two ever conflict, the signed scope wins.
Term and notice
Retainers start with a three month minimum, then continue month to month. After the minimum, either side may end the engagement with 30 days written notice. We do not use annual lock-ins or automatic multi-year renewals.
Fees
Retainer fees are quoted per engagement and invoiced monthly in advance unless agreed otherwise. Advertising spend is separate from our fee and is normally paid by you directly to the platform, so it stays in your name and under your control. Invoices are due within the period stated on them, and we may pause work on overdue accounts after giving notice.
Scope
Work outside the agreed scope is quoted before it starts. We will not do extra work and surprise you with an invoice for it.
What we need from you
Timely access to the accounts and assets the work depends on, a named person who can approve things, and accurate information about your business and products. If approvals or access stall, timelines move, and fees for that period remain payable.
Ownership of work
Once an invoice is paid in full, the deliverables we produced for you under it are yours: the campaigns, the content, the copy, the designs and the code. Accounts we set up are created in your name from the start. We keep ownership of our own methods, templates, internal tools and general know how, none of which are exclusive to any client.
You confirm that anything you supply to us, including logos, images, copy and product claims, is yours to use.
Results
We commit to the work, the reporting and honest recommendations. We do not guarantee specific rankings, placements, impressions, leads or revenue, and you should be cautious of anyone who does. Results depend on your market, your product, your pricing and platforms we do not control.
Third party platforms
Our work runs on platforms such as Meta, Google, TikTok, Shopify and email tools, each with its own terms, pricing and policies. We are not responsible for their outages, policy changes, account suspensions or price rises, though we will help you deal with them.
Confidentiality
We keep your business information confidential and expect the same in return. We will not name you as a client publicly without your say so.
Liability
Nothing in these terms limits liability that cannot legally be limited. Otherwise, neither side is liable for indirect or consequential losses, including lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.
Ending an engagement
Either side may end the agreement after the minimum term with 30 days notice, or immediately if the other side materially breaches it and does not fix the breach within 14 days of being told. On termination you pay for work delivered up to that point, and we hand over the assets and access that belong to you.
Governing law
These terms are governed by the laws of the State of New York, and the courts of New York have exclusive jurisdiction over any dispute. Before going to court, both sides agree to try to resolve things directly.
Changes
We may update these terms. The version in force for your engagement is the one in effect when your scope was agreed, unless we both agree otherwise in writing.
